News:- Marriage through Chunni ceremony valid, rules High Court.

 

Context:-Legal recognition to the customarily accepted system of marriage through chunni ceremony.

 

What is Chunni Ceremony?

  • The boy puts a chunni or a dupatta around the girl & accepts her as his wife. Even in Himachal and J&K, it is called “Chaddar Andaz”.
  • Both parties call a Granthi or a Priest to perform “Ardas” & started residing and cohabited together.

 

Background:-

The ruling holding this form of marriage to be legally valid came in a case where the husband wanted to escape the liability of paying maintenance to his second wife on the ground that it was not a valid marriage.

The Bench also held that a wife was entitled to maintenance even if she was able to establish that the couple was residing together as a husband & wife and there was cohabitation. The husband had moved the court challenging judgement dated Jan,6,2011 passe by a Judicial Magistrate directing him to monthly Pay Rs 3000 as maintenance.

The wife in the case married the petitioner husband in Nov 2004. They opted to marry through Chunni Marriage as it was the second wedding for them. Her counsel added that the marriage was solemnized in accordance with customs and ceremonies accepted by the petitioner husband. That was the reason why started residing together and cohabitate for a long time.

Bench asserted that “Even after the codification of Hindu Law, the customs have been protected”.

Section 7 of the Hindu Marriage Act specifically provides that a Hindu Marriage may be solemnized in accordance with the customary rituals and ceremonies of the parties. It is not necessary that the customary ceremonies may be of both parties; rather it may be of either of the parties of the marriage”.

Context:-  The Punjab Government has issued a notification regarding 4 per cent reservation, which was earlier 3 per cent, for physically challenged persons in promotions and direct recruitments in government departments.

 

Notification issue under which act?
  • The Rights of Persons with Disabilities Act, 2016.

 

What does this act say?

  • According to Article 34 of the act, the reservation will be given for ‘A’, ‘B’, ‘C’ and ‘D’ categories in promotions and direct recruitment. He said the persons suffering from blindness and low vision would be given 1 per cent reservation whereas those who are deaf and hearing-impaired would also be provided 1 per cent reservation. Locomotors disabilities will be given 1 per cent reservation while those suffering from autism, intellectual disability, specific learning disability and mental illness would also be given 1 per cent reservation.
